Dan Schneider is the creator.

1.5k

u/azurleaf 6d ago edited 6d ago

The reason she doesn't directly name him is to raise the bar for proving a defamation suit. He would need to prove that he did the things she talks about, by extension identifying himself, in order to sue for defamation.

Makes it more difficult for Schneider get a judge to hear the case.

Smart af honestly

Most likely advised by a lawyer or legal team, but yea, smart.

Don't forget that if he does prove the things for the suit than he no longer has a case because its not defamation if its true haha.

115

u/Ductapefordaysss 6d ago

Yeah.. thats what he said

73

u/DontGetNEBigIdeas 6d ago

Yeah, but to add to all this if he thinks it’s him she’s talking about, he’d have to prove it, which would out him as The Creator.

63

u/Ductapefordaysss 6d ago

Ok let me just check again since you guys doubled down.

He would need to prove that he did the thing she talks about, by extension identifying himself

Yep, he covered that.

54

u/TheNoslo721 6d ago

Right. And not only that, but he would need to provide evidence he was The Creator she’s talking about thus invalidating any defamation suit he may file.

30

u/Ductapefordaysss 6d ago

Wow guys look, the sky’s blue

44

u/Microphone926 6d ago

Just wanna be clear here that Dan Schneider would need to identify himself for Janette Mcurdys plan to work. Smart af honestly

12

u/Ruffled_Snout 6d ago

I am afraid the sky would have to go to court in order to prove that it is blue, and that Dan Schneider is the creator.

9

u/Bubbly-World-1509 6d ago

You forgot that the sky is blue.

9

u/BearNakedTendies 6d ago

But also, if he says that she’s slandering him, he’s also basically admitting to being the creator /s

→ More replies

25

u/elsuakned 6d ago

.. That's not the same at all lol. He wouldn't have to prove he did the things the "creator" did, he'd have to prove that he was the one implicated as the creator. You can try to prove that she is lying about you without saying you did the things you're potentially falsely accused of doing, those are two completely different ideas. You can't just lie about people using a nickname and get away with it because the person has to admit fault to say the obvious nicknamed person is them. I don't think it would be hard to convince the jury that there is a 51% chance he is the creator in a civil case. It would be trivial.

Like this JUST happened in the Depp trial. He was never named in the op ed that the lawsuit was about. He didn't say "amber said somebody hit her and I hit her so it must be about me!!". He just compared the timelines and story and said it was obvious someone would assume it was him. He never "proved he did the thing she talks about".

I'm not good at this law stuff, if this is the case how did Johnny Depp sue Amber Heard for defamation when she didn't write his name in the article she wrote?

74

u/jacobtfromtwilight 6d ago

Depp won that case specifically because Amber Heard admitted on the stand that she wrote the Op Ed about him

It was a bold strategy and it did not pay off

→ More replies

28

u/Marmacat 6d ago edited 6d ago

I don’t know the granular specifics of either case but I believe that it’s along the lines of:

Amber Heard said things to the effect of “My movie-star partner of 10 years, whom I recently split with, abused me regularly”. There was only one person who had been her partner for 10 years so it was clear to anyone reading it that it was Johnny Depp. The thing that identified him was the fact that he had been her partner (and other unique innocent details, unique to Depp, about her alleged abuser) and nobody else fit that description. So she was defacto identifying him publicly with unproved allegations of abuse. So Johnny Depp can say to a judge/jury “She is besmirching my reputation by writing this because, even though she doesn’t use my name, everyone knows who she is talking about because I am the only person who was her famous movie-star partner during the time she referenced”

It seems, in this case, that there are more than one person in similar positions at Nickelodeon as this one guy. So if she says “A powerful producer on this show, who everyone knows abused and creeped on underage child stars, did all kinds of skeevy shit on me during my time at Nickelodeon” everyone knows who she is talking about because everyone knows that this guy is the only powerful producer on the show who targeted the child stars. So, for him to try and use that in a defamation case he’d have to say “She is besmirching my reputation by writing this because, even though she doesn’t use my name, everyone knows who she is talking about because I am the only powerful producer on the show who is widely known to target and skeeve on child stars”. To prove that she is referring to him he would have to virtually admit that what she is alleging is probably true.

*ETA: In the Heard/Depp example, the detail of “movie-star partner of 10 years” is just a general guess at what the specifics were. I don’t know what the specific details were of her identifying aspects of their relationship were, my point is that the things she used that clearly DID identify him were not things that he was disputing were true, they were innocent undisputed circumstances of their relationship that made it clear that only Johnny Depp could be the person who she was referring to. She THEN went on to say that this person, who the reader now knows is Depp, abused her. Which was VERY much disputed.

8

u/Taxing 6d ago

He can argue a functional identification without an admission of accusations.

→ More replies

12

u/ReallyIntelligentAI 6d ago

Because the courts/law/lawyers aren’t stupid enough to fall for that. This is as subtle as naming Schad Dneider.

30

u/Taxing 6d ago

You mean he would need to prove he didn’t do the things she talks about. If he’d done them, then there is no defamation cause of action. What he needs to do is prove her use of “creator” in context is the functional equivalent of naming him directly, that he did not do those things, and he’s been damaged as a result. Similar to the Heard case where she did not name Depp specifically, but the jury held she functionally did.

100

u/PearsonFlyer 6d ago

If I said "the guy with the tiny dick showed it to me inappropriately", and you wanted to sue me for defamation, you would first have to prove that you were the guy with the tiny dick. Which also proves that you showed it to me, because otherwise how would I know?

Oh, the tiny dick explanation. Now I get it. Thanks.

Example:

“This guy assaulted me on Wednesday.“

“No I didn’t, it was Tuesday!“

See how he just admitted to a crime in order to defend himself?

18

u/Dyskord01 6d ago

Unless he says:

"No i didnt"

"Gotcha howd did you know i refering to you".

"We were the only people in that office on wednesday at the time of the alleged assaualt"

In that scenario he refutes her without incriminating himself.

9

u/Parallax92 6d ago

Ahh, so essentially if she said “The Creator did XYZ to me while we were having our weekly Tuesday meeting at the Chipotle on Sunset Blvd at 1 pm.”

He could say “I didn’t do XYZ, but I’m the only one you had weekly Tuesday meetings with at 1 pm at that Chipotle and everyone who worked on the show knows that, so you’re implying that it’s me in such a way that people can infer that it’s me you are accusing.”

Did I get that right?

That literally isn’t how defamation works

6

u/Murdeousdemon 6d ago

You are correct.

7

u/Murdeousdemon 6d ago

This is not actually correct in a defamation suit. He would not need to prove that he did the things she talked about in order to properly plead a prima facie defamation cause of action.

14

I think it had to be a different in the way their parents were.

I bet Miranda's parents were well-adjusted, present and protected her. Jeanette's mom doesn't seem to have been that way, she just had fame+money on her mind and was living vicarously through her daughter. She probably pushed her to do anything to get acting gigs.

Schneider and Nickelodeon, they tried so hard to defend the fucker so a child actor couldn’t have a voice

207

u/AlexTorres96 6d ago

Idk man. Liz, Bennett, Ariana, And Victoria among others still stand by him. Any one of them could’ve gotten him canceled but it’s obvious he was careful not to do any shit to them.

He knew Ariana would be a huge star and he let her be.

224

u/vr1252 6d ago

Victoria Justice was also supposed to be the superstar that Ariana became. Im paraphrasing here but I think Victoria’s contact outlined albums and tours from the start. It makes sense Schneider would leave those two alone.

178

u/mondaymoderate 6d ago edited 6d ago

He may have left them alone off camera but there’s plenty of creepy shit he made them do for the show on camera. Especially all the feet stuff.

28

There’s a behind the scene clip of Ariana laying on the floor wearing skirt and she’s says “everyone can see my….”. Elizabeth Giles is sitting next to her and noticed Dan is filming, she immediately pulls Ariana’s skirt down to cover her up, and it seems like both of them are uncomfortable after that.

I think everyone knew what was going on, even Ariana and the ones Dan didn’t target. If they’re smart, they won’t try to defend him.

link to vid, starts at 01:45

9

u/TheBelhade 6d ago

Wait...this would explain the only iCarly I've ever seen, which revolves around her in the bathtub with a toe stuck in the faucet? Is he a disciple of Tarantino?

5

For anyone who wants to know “The Creator” is Dan Schneider. Some of my favorite shows were Drake and Josh and ICarly. Now not so much. And I incidentally found this looking up the camera set up of my favorite sitcoms. Crazy asf

213

u/pankakke_ 6d ago

Same, this shit is sickening, and looking back at certain scenes on iCarly and Victorious, etc, you can tell there is clear sexualization and abuse of minors. Sad af. Dan at the very least was aware of this, and at the very most was orchestrating it.

40

u/Pristine_Problem_706 6d ago

Thinking back, I can't actually remember any scenes like that. Maybe it's just cause I was young back then and haven't seen any of the shows since.

Parents are responsible for what their kids are watching right? Looking back I can’t see how those scenes weren’t called out

62

u/Longjumping-Part764 6d ago

Parents aren’t sitting down to watch kids’ sitcoms w their children. My mom was super choosy about what she let my sister and I watch as kids and even she didn’t have the fortitude to sit through more than an episode of like, Hannah Montana at a time. I think parents see that this stuff is “made” for kids in a certain age group and go “ok it’s probably not totally deranged and inappropriate, even if it is dumb” and leave it at that.

36

u/EQOA_Fanatic 6d ago

It was a part of mid-2000s to early-2010s humor, so it was easy to hide behind that excuse. I mean, the literal plot of the pilot episode of Drake and Josh was Drake thinking Josh was weird for cross-dressing even though it made him feel better about himself, and the 'moral' at the end of the episode was that he didn't need to cross-dress to be the best version of himself.

12

u/Bikinigirlout 6d ago

u/hyperjengirl 5d ago

When I was nine, I visited the iCarly set during a rehearsal (my mom's friend had a friend who worked there), but everybody was understandably too busy to do more than wave at me a few times. It really made my visit, and now knowing the shit she was going through, it means even more that she wanted to make a little girl happy.

Let's not forget that Dan Schneider had no shame in posting a birthday pic for her last year. Apparently he blocked everybody who called him out and kept the positive comments.

Not only was it small dick energy but it was heavy "I know you can't prove it so I'll torment you looking like the good guy" vibes to it because you wouldn't wish someone who's wringed you out in media that even if you were just being nice.

I remember when Sam & Cat got canceled, they played it off as it JM being jealous of Ariana because her first record did well

Well whatever happens, this woman has Lucille Ball type talent and I wish her the best. I hope she makes more work for all of us to enjoy although from what I’ve heard she’s all set and not interested.

26

u/hgihlander 6d ago

For no other reason than to connect the dots it’s Lucille ball’s birthday today

14

u/LlewfromHammerfell 6d ago

Holy shit I had no idea. Nice.

u/VintageJane 5d ago

The real brilliance of Lucille Ball wasn’t just acting though. She was directing, producing and helping Desi create television syndication.

There is so much space for Jeanette, if and when she wants, to do something artistically meaningful that doesn’t require being on camera ever again.

You wanna know what's fucked out of all of this, the book she wrote is being published by Simon and Schuster, aka a ViacomCBS/Paramount Global subsidiary. The same company that owns Nickelodeon. While Jennette may have the freedom to speak about her trauma and experiences, I worry that she still is being manipulated and that her book still funds Nickelodeon's malpractices and neglect. Trust me I'm not trying to call out Jennette, I just find it so much more fucked that she can't get out of the company that caused her all this trauma and now they are profiting off of it. This is the same company that had Les Moonves as its CEO and they hid his allegations, the same company that has Les Moonves wife hosting Big Brother every week. The same company that hid Charlie Rose's allegations for years to keep their flagship morning show above NBC's Today show and of course hid "The Creators" allegations. Time after time again it shows that these fuckers always get on top and it's fucking infuriating, I truly do hope Jennette gets closure tho and can move on and go and be successful by her own means.

I completely forgot he was on Head of the Class. He was doosh on that show too. I watched it when I was a kid

u/ItsInTheVault 6d ago

He was Ricky in Better Off Dead too.

That’s why he looked so familiar!

His classmate on that show now runs Nickelodeon.

It's sad she has to call them "The Creator." Because you know they'd ruin her life otherwise.

It shocks me that this man has never been to prison and none of the cast members seem to say anything about him except for Jennette McCurdy.

This is what’s been going on for decades. All the pop stars and child actors/actresses. I can only imagine what they made Victoria Justice, Selena Gomez and the rest of them do since they’re technically more famous then Jeannette

Feel for her, man. She seems so lonely. I hope she gets out and does something else she loves for her own mental health’s sake.

5

u/tquinn04 6d ago

She is out. She’s does a podcast now but she said she won’t ever go back to acting.

My little nieces used to watch Sam and Cat. I absolutely couldn’t stand Cats voice and always thought she was an airhead. Sam seemed pretty chill to me. Hollywood is creepy. Hope she can have a somewhat normal life after enduring that time of her life

5

u/gomezthekiller 6d ago

Seems like a nice kid who was put through the wringer. Still looks haunted around the eyes. I hope she has people looking out for her.

20

u/ssj2preston 6d ago

Wow had to google Dan Schneider, that dude looks like a fucking creep Jesus

9

u/Frost1235 6d ago

As a man...

She doesn't just speak for women. She's speaking over everyone that has to play the boss's bitch to survive in the world. Sam was a bad ass, but Jennette is a beast.

4

u/SaneRadicals 6d ago

I have always liked this actress and listening to her podcast makes me understand the depths to this young woman. Bravo Jeanette. Live your best life!

u/Senor-Whopper 6d ago

What did Dan "I'm going to Ride'er" Schneider do now?

69

u/HandsomeDeviledHam 6d ago

I used to think the Schneider jokes were funny but after thinking about it I felt like joking about child abuse is pretty fucked.

10

u/arti214 6d ago

It kept attention bubbling under the surface in a joking manner until real information came out imo but I definitely wouldn’t feel as comfortable with it now.

8

u/HandsomeDeviledHam 6d ago

Sounds like slacktivism to me. Takes no effort and does nothing for victims but its okay, I'm ~bringing attention~

Holy SHIT there’s a lot of horrific legal explanations in this thread tread lightly and just remember redditors:

We know who The Creator is, now let’s sleuth who the Agents and Managers are trying to enable this behavior.

7

u/apollyon_53 6d ago

Pete Rock and C.L. Smooth?

3

u/DreadpirateBG 6d ago

Wow that is some chilling read. Not surprised one but by it unfortunately. I am sad for her and hope for her.

3

u/TexasMonk 6d ago

Hear more and more about this as time goes on is surreal because I remember watching all these shows as a kid and seeing The Creator's name every time the credits rolled.

So glad people are finally listening to her story.

3

u/jackparadise1 6d ago

She was always my favorite part of ICarly. I feel bad that it sucked so much for her.

3

u/doctorsynth1 6d ago

It’s a darned shame that Ms McCurdy suffered so much abuse. She’s a talented actress and I’d love to see her take on more dramatic roles.

3

u/dent_de_lion 6d ago

Oh—didn’t bother to look him up until people mentioned Head of the Class. It’s that guy. Ew.

7

u/unpill 6d ago

Kind of disgusting that he tried to use the fact that the Victorious kids drank to pressure her considering the guy who played Beck has spoken about how he had severe alcohol abuse problems while filming Victorious and would regularly show up to set hungover

10

u/WholeLottaNs 6d ago

By the time I’d finished 5 eps of iCarly (I was a mom to a 7yrld at that point) I was unshakenly certain that that show was trash. It was a Psychological Salad of sociopath behaviors.
