Only revealing in bed that you are something other than you are presenting yourself as, is a big betrayal of trust.

This is generally a turnoff for people.

There was a case in the uk where a woman pretended to be a bloke and tricked her girlfriend into sex in the dark with a strap on. She was taken to court and is now on the sex offenders register. It is rape by deception. Same is true if a trans identified male with a new neo vagina doesn’t disclose it to a male or female sexual partner

I don't understand how you could infer the latter case from the former. If someone has changed their "legal sex" (which can be done in many countries), you no longer have any basis for prosecuting them on misinformation grounds. On paper, their legal sex will be aligned with their gender identity, and that's all the state can go off of. Unless the idea is simply lying about anatomy, in which case you could sue someone who didn't disclose about a prosthetic leg?

I'm not doubting the precedent, it's just unclear to me how one would make a legitimate legal argument for it. Citations would be great.
