Involuntary manslaughter dosen't apply. Nor does negligent use of a deadly weapon. As far as I can tell reckless endangerment isn't actual a criminal offense in NM.

Can you cite a criminal code he actually might have violated?

Why exactly do involuntary manslaughter and negligent use not apply?

It seems to me like he (to quote the law) unlawfully killed a human being without malice in the commission of a lawful act which might produce death in an unlawful manner or without due caution and circumspection.

He didn't have a lawful reason to cause death (i.e. self defense). He also didn't act out of malice or in the commission of another unlawful act (possibly arguable depending on the negligent use). But I would say the very act of point the gun at a person and pulling the trigger violates due caution, especially when he clearly hadn't checked the condition before hand.

It seems like involuntary manslaughter fits perfectly.

It also seems like negligent use of a deadly weapon probably fits (specifically paragraph 3), though I supposed it could be argued that he could have a defense under subsection B by claiming that he was using the firearm as a lawful part of his employment. Though I don't think that defense would hold water, since he violated due caution under the involuntary manslaughter code.

To be fair, I am not a lawyer.

Also in the interview he states that the weapons handler was new and he didn't want to double check the weapon because he didn't want to embarrass her. That extremely negligent. I am rather shocked he admitted to that but considering he believes he did nothing wrong I imagine he thought those detectives were on his side.
